Investment company and its director guilty of serious offences

After a serious fire and prosecution for ten fire safety breaches at a block of Preston flats, 3i Investments Ltd has been fined £10,000 and £11,660 costs; while sole director Faisal Hussain received a six-month prison sentence per offence, suspended for two years, plus 240 hours’ community service.

The fire on 14 June 2014 at 17 Grimshaw Street had been deliberately set by the resident of a second-floor flat in a three-storey mid-terraced property converted into flats. She was sentenced to three years’ imprisonment on 30 July 2015 for setting the fire, which spread through the flat and means of escape from the premises, causing the resident from the flat across the hall to run past the fire to make her escape.

In addition, two PVC windows in the flat where the fire was located failed under the intense heat and fell three storeys into the back yard, narrowly missing a resident in the ground floor flat who had just left the premises.

Both defendants pleaded guilty to ten breaches of the Regulatory Reform (Fire Safety) Order 2005 and were successfully prosecuted by Lancashire Fire and Rescue Service on 2 September 2015. Sentencing was adjourned and took place on 18 November.

They had failed to provide adequate fire separation between the means of escape and the flats; a suitable and sufficient fire risk assessment and fire evacuation procedure; effective fire safety management; an adequate fire alarm system; adequate fire doors to one of the second-floor flats where the fire was located; adequate fire safety signage to the escape routes; and adequate maintenance of the existing fire alarm system. Also, they had failed to review the existing fire risk assessment, and to coordinate and cooperate with each other regarding the fire safety provisions.
